Privacy Policy

This privacy policy describes the means and manners applied by Intuos for the processing of your data when you navigate on the website www.Intuos.it or request information about the products and services or a demo.

Intuos hereby intends to clearly provide you, in accordance with art. 13 of the Regulation EU 2016/679 (the “Regulation”), with the following information regarding the processing of your data:

  1. Data Controller

The data controller is Intuos S.r.l. with registered office in Via Luigi Bonelli, n. 40, 00127, Rome, Italy (“Intuos”).

  1. Which personal data are processed?

The personal data processed by Intuos may be:

  1. browsing data (for instance, IP addresses, URI, parameters regarding user requests, online identifier);
  2. cookies and data collected through tracking technologies;
  3. personal data provided by you when you enter a request (name, email, contact information).

The provision of your data is optional. However, if your personal data are not provided, Intuos may not be able to guarantee that the website properly operates or to respond to your requests.

Browsing data

Computer systems and software procedures used to operate the website obtain, during their normal operations, some personal data whose transmission is implicit in the use of Internet communication protocols, like IP addresses or domain names, the URI (Uniform Resource Identifier) addresses of requested resources, the time of the request, the method used to submit the request to the server, the size of the file received in reply, the numerical code indicating the status of the reply given by the server (successful, error, etc.) and other parameters regarding the user’s operating system and computer environment. This information is not collected with the intent of associating it with identified users but, by its nature, it could lead to the identification of users by processing and associating them with data held by third parties. This data is used for the sole purpose of obtaining anonymous statistical information on the use of the website to check its correct functioning, to identify anomalies and/or abuses; in any case it is deleted immediately after the processing itself. The data may be used to ascertain responsibility in the event of potential cybercrimes against the website or third parties.

Data voluntarily provided by you

Intuos may also process the information you provide when making a request through a request form or by email or phone (by way of example, when you request information about a product or book a demo). Such data include your name and contact information and the content of your request.

  1. For what purposes does Intuos process your data and under which legal basis?

Intuos will process your personal data for the following purposes:

  • Fulfill your request: to allow browsing the website and to address your requests. The processing is lawful under art. 6 (1)(b) of the Regulation that states that “processing is necessary … in order to take steps at the request of the data subject prior to entering into a contract”;
  • Comply with applicable laws: to fulfill any obligations set forth by applicable laws, regulations or European legislation, or to fulfill requests from public authorities, according to art. 6 (1)(c) of the Regulation which provides that processing is lawful if “… is necessary for compliance with a legal obligation to which the controller is subject”, including for instance the obligation to guarantee security of the website and your data;
  • Sending you email about our products: to send you newsletters or conduct direct marketing by e-mail with respect to services and products which are alike those that you have purchased or requested information about. This processing is lawful under art. 130 (4) of the Italian Privacy Code (D. lgs. 196/2003). You can unsubscribe to our newsletter or request by email to stop receiving such marketing communications at any time;
  • Keep you informed on our products by other means: to inform you about our activities, products and services using means other than email, including sms, phone call without operator, paper mail, telephone with operator, with your prior consent, according to art. 6 (1)(a) of the Regulation, under which “the data subject has given consent to the processing of his or her personal data for one or more specific purposes”.
  1. Are the data disclosed to any third party?

Your personal data are processed by Intuos and its authorized personnel. Your personal data may also be disclosed to third parties, duly appointed and instructed according to art. 28 of the Regulation, who provide services or products which are necessary to accomplish the purposes described above (for instance, technical support or maintenance of the website, server hosting, digital marketing).

Intuos may also be requested by public authorities, law or order to disclose certain personal data to public authorities or agencies.

Your personal data are not shared with recipients who are situated outside the European Economic Area. Should this be necessary in the future, Intuos will adopt any available adequate safeguards according to articles 44–49 of the Regulation.

  1. For how long will the data be retained?

The retention period varies depending on the purpose for which the personal data are processed.

As a general rule, personal data will be retained for the time strictly necessary to achieve the purpose for which they are processed.

Personal data processed to:

  • fulfil your request, will be retained until your request is open;
  • comply with applicable laws, will be retained up until the time stipulated by the specific obligation or applicable law;
  • send you email about our product, will be retained until you object to the processing;
  • keep you informed on our products by other means, will be retained until the earlier of: a) 24 months after the last interaction on the website or b) the withdrawal of consent to the processing for this purpose.

Please note that according to Italian laws (Art. 2947 (1)(3) of the Italian Civil Code), under certain circumstances, Intuos is granted the right to retain personal data to protect its interests before court having jurisdiction for ten years.

  1. Which are your rights with respect to the processing of your data?

Pursuant to articles 15 to 22 of the Regulation, you have the right to access your personal data, to request their rectification or erasure, the restriction of data processing in the cases provided for by art. 18 of the Regulation, where technically possible; to obtain in a structured, commonly used and machine-readable format the personal data concerning you; and to object to the processing in the cases provided for by articles 21 and 22 of the Regulation.

You can also file a complaint with the competent supervisory authority (the Italian Personal Data Protection Authority), pursuant to art. 77 of the Regulation, if you believe that the processing of your personal data is contrary to the applicable laws.
